THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.20305 OF 2017 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, came to be filed seeking to declare the action of the respondents in interfering with the personal life and liberty of the petitioner without following due process of law, as illegal and arbitrary.

Heard the learned counsel for the petitioner and learned Assistant Government Pleader for Home. With their consent, the Writ Petition is disposed of at the stage of admission itself. Since this Court is not going into the merits of the case, there is no necessity to issue notice to unofficial respondents. Learned counsel for the petitioner mainly submits that the fourth respondent, at the instance of the fifth respondent, is harassing the petitioner, by calling him to Police Station and thereby interfering with the personal life and liberty of the petitioner.

Learned Assistant Government Pleader denies the allegations made in the affidavit filed in support of the Writ Petition and submits that the allegation of official respondents interfering with the personal life of the petitioner is incorrect. She further submits that if any action is sought to be taken by the respondents-Police, the same would be in accordance with the procedure established under law.

Having regard to the above, the Writ Petition is disposed of directing the respondents-Police not to interfere with the personal

life and liberty of the petitioner without following due process of law.

Miscellaneous petitions pending in this writ petition, if any, shall stand closed. No costs.
