THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.23260 OF 2017 ORDER:

The Writ Petition is filed challenging the action of the respondents in proposing to interfere/ dispossess/ encroach with the agricultural lands of the petitioners situated in Sy.Nos.75, 76 & 77 of Upparapalli Village, Rajender Nagar Division, Ranga Reddy District, admeasuring to an extent of totally Acs.4.37 guntas without any due process of law, as illegal and arbitrary and consequently, direct the respondents not to interfere/ dispossess/ encroach the petitioners from the said land without following due procedure. The Petitioners 2 to 4 are the sons of the 1st petitioner. The 1st petitioner possessed an extent of Acs.4.37 gunta of land and the petitioners 2 to 4 possessed an extent of Acs.2.08 guntas of land in Sy.Nos.75, 76 & 77 of Upparapalli Village, Rajender Nagar Division, Ranga Reddy District.

The petitioners have constructed a wall around their land. The neighbouring land owner is trying to develop his agricultural land for which he required an approach road through the land of the petitioners and therefore, with the help of the respondents, they are trying to encroach the land of the petitioners by demolishing the existing wall of the petitioners. The subordinates of the 3rd respondent along with the neighbouring land owners of the petitioners, visited the land of the petitioners and demarcated the site. The petitioners objected the acts of the subordinates of the 3rd respondent. If the respondent authorities are allowed to proceed with the demolition of the wall existing in the land of the petitioners, they will suffer irreparable loss. Hence, the present Writ Petition.

When the matter is taken up for hearing, learned Standing Counsel for the respondents 2 and 3 submits that if the respondents intend to lay road through the land of the petitioners, they would follow the due process of law and appropriate steps would be taken in accordance with law.

Recording the submission of the learned Standing Counsel, the Writ Petition is disposed of. There shall be no order as to costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed. ______________ RAJA ELANGO, J July 13, 2017 KTL
