HON'BLE SRI JUSTICE S.V.BHATT W.P.No.17450 OF 2016 ORDER:

Learned counsel for petitioner is satisfied if the alternative prayer of petitioner to dispose of the representation dated 14.05.2016 is considered and ordered.

The Assistant Government Pleader by relying upon counter affidavit of respondent No.4 contends that the subject matter is a water body and the possession claimed by petitioner is factually incorrect. Be that as it may, as the prayer is limited to the extent of directing respondents 3 and 4 to consider the representation, I am satisfied the writ petition can be disposed of by this order. " The petitioner is given liberty to re-submit representation to respondents 3 and 4 by enclosing a copy of this order within four weeks from today.

The respondents are directed to look into the grievance and pass orders expeditiously" .

The writ petition is, accordingly, disposed of. There shall be no order as to costs.

Consequently, miscellaneous petitions, if any pending, stand closed.
