HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No. 6647 OF 2005 08-12-2015 Between:

N.P. Ramachandra Naidu ... Petitioner And The Dy. Transport Commissioner and Secretary, Regional Transport Authority, Chittoor ... Respondent

HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No. 6647 OF 2005

ORDER: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Heard learned counsel for the parties.

Learned counsel for the petitioner, at the outset, invited our attention to the judgment of Larger Bench of this Court in L.Royal Reddy and others Vs. Government of A.P. and others to submit that the impugned demand notice, dated 28-12-2004, issued by the respondent is liable to be quashed and set aside in view of the law laid down in the said judgment.

Learned Government Pleader for Transport appearing for the respondent, fairly states that the question raised in the instant writ petition is squarely covered by the judgment of Larger Bench and he has no objection for setting aside the demand notice.

The demand notice is accordingly set aside and the writ petition is disposed of.

Consequently, miscellaneous petitions, if any, stand disposed of. There shall be no order as to costs.
