HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.10025 of 2012 ORDER:

The petitioner states that he is a resident of D.No.6-2-113 Peddapalli Road, Karkhanagadda, Karimnagar District. He is residing in a residential locality. In front of the house of the petitioner, there is a hotel by name 'Wathan' which is causing inconvenience to the residents of the locality. When the fourth respondent wanted to start hotel business in the same premises, owned by the third respondent, without obtaining any licence from the second respondent, the petitioner submitted a representation dated 24.03.2012 to respondent Nos.1 and 2 against opening of the hotel. When no action was taken, the present Writ Petition was filed.

Even though the petitioner tried to take out notice on the fourth respondent, it was not served. However, notice to the third respondent was served but there is no representation.

No counter affidavit is filed by the second respondent even after four years.

In the circumstances, this Writ Petition is disposed of directing the second respondent to consider the representation of the petitioner dated 24.03.2012 and pass appropriate orders after making personal inspection of the

premises, in respect of which objection was raised by the petitioner.

The Writ Petition is, accordingly, disposed of. Miscellaneous applications, if any, shall also stand disposed of. No order as to costs.
