THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO W.P.No.24590 of 2017 ORDER:

Heard counsel for the petitioner, Sri S.S.Varma, learned counsel for respondent Nos.2 and 3 and the learned Government Pleader for Roads and Buildings appearing for 4th respondent. 2.

Petitioner has filed this Writ Petition assailing notice dt.02-11-2016 under sub Section (2) of Section 26 of the Control of National Highway (Land and Traffic) Act, 2002. On 06-09-2017, this Court granted direction to the respondents not to interfere with the land of the petitioner without following due process of law. 3.

Learned Government Pleader for Roads and Buildings representing the Assistant Executive Engineer (R&B), who is 4th respondent in the Writ Petition, has produced a letter No/W.P.No.24590 of 2017/NH 67/Atnajyr-Nellore Section dt.03-11-2017 withdrawing the impugned notice issued to the petitioner.

Therefore, the cause in the Writ Petition no longer survives for adjudication.

Accordingly, the Writ Petition is disposed of directing the respondents not to interfere with the possession and enjoyment of the petitioner over the subject property without following due process of law. No costs.

As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
