THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.23232 of 2011 ORDER:

This writ petition was filed challenging the action of respondents in selecting the site in Survey No.287 of Dasireddypally village for construction of buildings for the Z.P. High School of Chandavaram Village on the ground that it is far away from the village and located in a jungle.

This writ petition was initially dismissed on 18.12.2012 and upon filing Rev.W.P.M.P.No.3063 of 2013 and W.P.M.P.No.3064 of 2013 this Court passed an order on 12.02.2013 allowing the said review application and recalling the order dated 18.12.2012 and the construction activity started in Survey No.287 of the village was directed to be stopped.

Today when the matter is taken up for consideration, learned counsel for the petitioners produced before this Court a copy of the proceedings dated 23.02.2014 issued by the Collector, Prakasam District, directing the Tahsildar to handover advance possession of the land in Survey Nos.152, 300/2, 300/5 and 300/6 admeasuring an extent of Ac.2.70 cents of Chandavaram Village, Donakonda Mandal to the District Educational Officer, Ongole for construction of High School buildings to Z.P. High School, Chandavaram Village. Learned counsel for the petitioners submits that in view of the said proceedings, nothing survives for adjudication in the present writ petition.

Recording the said submission, this Writ Petition is dismissed as infructuous. No order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
