THE HON'BLE SRI JUSTICE SURESH KUMAR KAIT AND THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO WRIT PETITION No.9803 OF 2017 ORDER: (Oral) (Per the Hon'ble Sri Justice Suresh Kumar Kait) Vide the present petition, the petitioner seeks direction thereby to declare the action of the respondent No.3 in illegally confining the petitioner's son D. Harshavardhan, S/o late Dasari Babu Venkateswarlu, since 11.3.2017, as illegal, arbitrary and violation of principles of natural justice and consequently to direct the respondents to produce her son before this court.

2. Learned Assistant Government Pleader, who appeared on advance notice, has produced the alleged detenu before this Court.

3. We have interacted with the detenu. He stated that he was not taken into custody by the police or by any person. However, he himself came to Ananthapur to see his mother. He further stated that his wife lodged a missing complaint against him and so far no action has been taken by the said police, his wife has filed the present petition.

3. Keeping in view the statement made by the detenu, who is personally present in the Court, we are of the opinion that no further order is required to be passed in the present petition.

4. Accordingly, this Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any pending, shall stand closed.
