Heard learned counsel for petitioner and learned Government Pleader for Home.
02. According to petitioner on 17-11-2017 at 6 am, he heard cries from his third son, who was sleeping in his bedroom. Then petitioner and his second son went to bedroom and knocked the door. It was locked from inside. After repeated bashing of door, his daughter-in-law opened the door. Petitioner noticed that his deceased son was screaming in their bathroom lying on the floor with full of flames. He was shifted to Century Hospital, where on 18-11-2017, he succumbed to burn injuries. On 19-11-2017, second son of petitioner lodged a complaint with the Panjagutta Police. Based on said complaint, Crime No.712 of 2017 was registered. Petitioner suspected foul play of his daughter-in-law. Having made enquiries on the conduct of his daughter-in-law and that according to petitioner, she had intimate relationship with a person by name T.
Srikanth and said relationship continued even after the marriage, suspected that his daughter-in-law was responsible for committing crime. Petitioner, therefore, gave further complaint on 02-12-2017 to investigate the issue of death occurred to his son holding his daughter-in-law by name Sowmya as responsible. Alleging inaction on the said complaint, writ petition is filed.
03. Learned Government Pleader produced a copy of charge sheet filed in the Court of XIV Additional Chief Metropolitian
- 3 - Magistrate at Nampally vide SR.No.2832 of 2019, dated 05-03-2019. A prima facie reading of the contents of report would disclose that police have considered the subsequent complaint lodged by the petitioner on 02-12-2017 and duly taking note of allegations made in the said complaint, further investigation was done and filed final report. The police have suggested to treat the case as 'suicidal death due to burns'. Since final report is already filed, it is open for the petitioner to file objections before the competent Court on the issue of suspecting involvement of his daughter-in-law for death of his son.
04. Thus leaving it open to the petitioner to avail said remedy, the writ petition is disposed of. No order as to costs. Miscellaneous petitions pending, if any, shall stand closed. __________________ P.NAVEEN RAO,J 18-03-2019 Nvl
