This writ petition is filed seeking to issue a writ of mandamus, declaring that the petitioner is entitled for regularization of his services in the cadre of Driver after completion of 5 years of service in terms of the law laid down by the Hon'ble Supreme Court with all consequential benefits.
Heard Sri J.R.Mohanrao, learned counsel, appearing for the petitioner, and the learned Govt.Pleader for Services, appearing for the respondents.
It has been contended by the petitioner that during the pendency of this writ petition, his services were regularized, and only issue in this case is that the respondents have not released the increments from the date of his initial appointment till today on the ground that the present writ petition is pending.
Learned counsel for the petitioner contends that the writ petition be disposed of with a direction to consider the case of the petitioner for grant of increments.
Learned Govt.Pleader contends that the relief sought by the petitioner has already been granted by the respondents and no further adjudication is necessary.
This court, having considered the rival submissions made by the parties, is of the considered view that ends of justice would be met if the petitioner is permitted to make a representation to the respondents seeking release of his increments, within a period of two weeks from the
AKS,J WP_19120_2004 date of receipt of a copy of this order, and on receipt of such representation, the respondents shall consider and pass appropriate orders thereon, in accordance with law, within a period of 4 (four) weeks therefrom.
With these observations, the writ petition is disposed of. No order as to costs.
Pending miscellaneous applications, if any, shall stand closed in consequence.
