THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2569 of 2016 ORDER:

This criminal petition, under Section 482 of the Code of Criminal Procedure, is filed by the petitioner-Respondent No.1 seeking to quash order, dated 18.09.2015, in Crl.M.P. No.1234 of 2015 in DVC No.14 of 2015 passed by the IX-Metropolitan Magistrate, Miyapur, Ranga Reddy District.

The 2nd respondent is the wife of the petitioner. She filed DVC No.14 of 2015 against the petitioner seeking certain reliefs under the provisions of the Protection of Women from Domestic Violence Act. She filed the impugned application to direct the petitioner to permit her and her daughter to live in the own flat i.e. F.No.501, D.No.2-22-109/A, Plot No.12, Sri Venkata Krishna Heights, Vijaynagar Colony, Kukatpally, pending disposal of the DVC, before the Court below. The Court below allowed the said application through the impugned order. Aggrieved over the same, the present petition is filed. Heard and perused the material available on record. As per the provisions under the Protection of Women from Domestic Violence Act, the remedy of the petitioner is to file an appeal before the Court of Sessions, challenging order impugned. Hence, this criminal petition is liable to be dismissed. Accordingly, the criminal petition is dismissed.
