THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.1673 of 2025 ORDER:

Seeking the Court to enlarge the petitioner who is arrayed as accused in C.C.No.697 of 2020 on the file of the learned Additional Judicial Magistrate of First Class, Bhongir, on bail, the present Criminal Petition is filed. 2.

Heard Sri V. Sunil Kumar, learned counsel appearing on behalf of the petitioner as well as Sri Syed Yasar Mamoon, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioner submitted that the petitioner is arrayed as accused in C.C.No.697 of 2020, was falsely implicated by the police under sections 304(A) and 338 of the IPC without proper investigation. Despite being a bailable offence with a punishment of less than two years, the police filed a charge sheet, and the petitioner has been regularly attending court proceedings. He further submitted that due to ill health, the petitioner missed a Court date on 14.06.2024, resulting in a non-bailable warrant (NBW) being

issued. The petitioner is an illiterate daily wage laborer, was unaware of the Court proceedings and could not afford a lawyer. After being produced before the court on 04.02.2025, the bail petition of the petitioner was dismissed. The petitioner, with no prior criminal record, is a law-abiding citizen and the sole breadwinner for his dependent family. He respectfully prays for bail, assuring cooperation with the prosecution and the trial, with no intention of tampering with evidence or influencing witnesses. Therefore, he prayed the Court to grant bail to the petitioner by allowing this criminal petition.

In the light of the submissions made by both the learned counsel and considering the facts and circumstance of the case, this Court deems it fit to grant bail to the petitioner subject to the following conditions:

i.

The petitioner shall execute a personal bond for a sum of Rs.5,000/- (Rupees Five Thousand only), with one surety for a like sum to the satisfaction of the learned Additional Junior Civil Judgecum-Additional Judicial Magistrate of First Class, Bhongir.

ii.

The petitioner is directed to co-operate with the trial Court by attending the Court on every date of hearing.

iii.

The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.

iv.

The trial court is directed to provide legal aid to the petitioner, as he is unable to afford counsel.

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
