HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.13306 OF 2016 ORDER:

The grievance of the petitioners as espoused in the writ petition is that they had made a claim to the respondents invoking the jurisdiction under the Scheduled Tribes and other traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 and the respondents-authorities have not completed the process of settlement of their claims though the enquiry has been completed. Learned Government Pleader for Forest, on instructions, submits that even as on 22.02.2016, no orders have been passed by the Project Officer, I.T.D.A, Bhadrachalam and they have made over the claim of the petitioners to the Tahsildar's office for further serving the orders of the I.T.D.A, Bhadrachalam, on the claimants.

Learned counsel for the petitioners submits that though the authorities are stating before this Court that the orders have been made and communicated, there is no communication of the orders as required under Rule 12A(3) of the S.T. & Other Traditional Forest and Dwellers Act, 2006. To avoid the controversy, the 6th respondent-Mandal Tahsildar, Pinapakamanal, Khamma District within a period of ten days from today shall serve the orders passed by the I.T.D.A, Bhadrachalam and obtain acknowledgments from all the petitioners. It is also made clear that if any of the petitioners or other claimants who claim to have the privilege of benefit of the act of refusing to accept the orders, the Mandal Tahasildar shall be at liberty to dispatch the same through registered post with acknowledgement due and it shall be considered once they are put on notice under registered post for all the purposes, it shall be treated as orders having been complied with.

Subject to the above direction, the writ petition is disposed of. No order as to costs.

As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand disposed of as infructuous.
