THE COURT MADE THE FOLLOWING:

ORDER:

This writ petition is filed for the following substantive relief: "...to issue a writ, order or direction more particularly one in the nature of writ of mandamus declaring the action of respondents in interfering with petitioners' possessions and enjoyment of their respective lands, i.e., Ac.0.75 cents and Ac. 3.00 cents in Survey Number 1438/1 situated at Sayannapalem Village, H/o. Pulla Village, Bhimadole Mandal, West Godavari District, as illegal, arbitrary and contrary to G.O. Ms. No.83, Animal Husbandry, Dairy Development and Fisheries (Fish-II) Dept. dated

12.09.2007 r/w. G.O.Ms.No.18, dated 26.03.2008 issued by same department and consequently declare that the petitioners have deemed permission pursuant to application dated 29.12.2009 for converting their lands into fish tanks."

At the hearing, there is no representation for the petitioners. Learned Assistant Government Pleader for Fisheries (AP) submitted that the petitioners' application for grant of permission to convert their lands into fish tanks to carry on aquaculture was rejected by the District Level Committee on the ground that the lands are below +5 contour of the Kolleru lake. In view of the above submission, which remained uncontroverted, the writ petition is dismissed.

As a sequel to dismissal of the writ petition, interim order dt.9.6.2011 in W.P.M.P. No.17977 of 2011 shall stand vacated and the application shall stand disposed of as infructuous.
