HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN Writ Petition No.108 of 2012 ORDER:

The relief sought for, in this Writ Petition, is for a mandamus to declare the action of the respondents in not processing/ considering the application of the petitioner-school for recognition, even after fulfilling the requirements under the Andhra Pradesh Educational Institutions (Establishment, Recognition, Administration and Control of Schools under Private Management) Rules, 1993, as illegal and arbitrary.

By way of interim relief, the petitioner sought a direction to the respondents not to interfere with the day-to-day activities of the petitioner-school, by directing the respondents to consider the application of the petitioner. This Court, by its order in WPMP No.127 of 2012 dated 04.01.2012, granted interim direction as prayed for. The interim relief sought was to direct the respondents not to interfere with the day-to-day activities of the petitionerschool, and to direct the respondents to consider the petitioner's application for recognition.

It is not known what transpired thereafter. No counteraffidavit is filed on behalf of the respondents. Suffice it, therefore, to direct the respondents, in case the petitioner's application has not been considered so far, to consider the same and pass orders thereupon in accordance with law, with utmost expedition and, in any event, within three months from the date of receipt of a copy of this order. It is open to the respondents, after such an order is passed by them, to take necessary action thereafter in accordance with law. In case any order has already been passed rejecting the

petitioner's application for recognition, it is open to the respondents to take necessary action, pursuant thereto, in accordance with law.

The Writ Petition stands disposed of accordingly. The Miscellaneous Petitions pending, if any, shall also stand closed. No order as to costs.
