ORDER

The present criminal revision case is preferred challenging the order dated 08.05.2015 passed in Crl.M.P.No.314 of 2015 in Crl.A.No.324 of 2015 by the learned VIII Additional District and Sessions Judge, Ranga Reddy District at L.B.Nagar.

2. The petitioner/accused was tried for the offence punishable under Section 138 of Negotiable Instruments Act, 1881 and was convicted and sentenced to under go simple imprisonment for a period of one year for the said offence and directed to pay a sum of Rs.8,35,000/- to the first respondent/complainant towards compensation. Aggrieved by the same, the petitioner filed Crl.A.No.324 of 2015 along with Crl.M.P.No.314 of 2015 seeking suspension of sentence. By the order impugned, the lower appellate Court while suspending the sentence of imprisonment directed the petitioner to deposit a sum of Rs.1,60,000/- before the trial Court within one month from the date of the order. Aggrieved by the said direction, the present revision is filed.

3. Heard learned counsel for the petitioner and learned Public Prosecutor for the State.

4. Having regard to the facts and circumstances of the case and considering the status of the petitioner, the Criminal Revision Case is disposed of, with a direction to the lower appellate Court

not to insist upon the petitioner for deposit of the amount of Rs.1,60,000/- and to proceed with the appeal and dispose of the same in accordance with law.

5. With the above direction, the Criminal Revision Case is disposed of. Miscellaneous Petitions, if any, pending in this revision shall stand closed.
