THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.3372 OF 2018 ORDER:

The petitioner states that he is the absolute owner and possessor of an extent of Acs.3.00 in Survey No.102/5 of Gundalapadu Village, Bhadrachalam Mandal, Khammam District. Originally, it belongs to one Ramaiah and he executed a Will on 09.05.2002 bequeathing the said land in favour of the petitioner. The said Will was registered in the Office of the Sub Registrar, Rampachodavaram. The said Ramaiah died on 16.03.2004. When the sons of Ramaiah were interfering with the possession of the petitioner, he filed O.S.No.296 of 2013 before the Sub Divisional Magistrate-cum-Special Assistant Agent to Government, Mobile Court, Bhadrachalam, for declaration of title and permanent injunction. The said suit was decreed on 09.12.2014. The son of Ramaiah also filed another suit in O.S.No.

37 of 2016 before the Sub Divisional Magistrate-cum-Special Assistant Agent to Government, Mobile Court, Rampachodavaram, for permanent injunction and the same was dismissed on 25.04.2017. In those circumstances, the petitioner sought for mutation of his name in respect of the land in an extent of Acs.2.37 cents in Survey No.102/5 of Gundala Village and when no action was taken by the fourth respondent, the present writ petition is filed.

In spite of granting time to the learned Government Pleader for getting instructions, he did not get any instructions. In view of the same, the writ petition is disposed of directing the fourth respondent to consider the application filed by the petitioner for mutating his name in the revenue records as per the

title claimed by him and pass appropriate orders thereon pursuant to his application, dated 14.03.2017, within a period of four weeks from the date of receipt of a copy of this order.

The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any pending, in this writ petition, shall stand closed. There shall be no order as to costs. __________________________ A.RAMALINGESWARA RAO, J 15.02.2018 pln
