This Writ Petition is filed challenging the notice dated 22.04.2017 issued under Section 91 of Cr.P.C pursuant to registration of Crime No.112 of 2017.

The petitioners state that there are two civil suits pending and in view of the notice now issued and submission of documents, any opinion formed by the concerned Station House Officer would have an impact on the pending civil proceedings. It is made clear that the criminal proceedings are independent of the civil proceedings and the opinion or observation in the criminal proceedings are not binding in the civil proceedings and it is open to the parties to agitate their rights in the pending civil proceedings without being influenced by any observations in the criminal proceedings. The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed.
