I.A.No.1 of 2026 This application is filed praying this Court to suspend the judgment passed by the learned I Additional District & Sessions Judge at Karimnagar in S.C.N.D.P.S.No.12 of 2023, dated 30.01.2026 and enlarging the appellant Nos.1 and 2 on Bail, pending disposal of the Criminal Appeal, wherein the trial Court convicted the petitioner herein for the offences punishable under Sections 8(c) r/w 20(b)(i)(B) of the NDPS Act, 1985.

Heard learned counsel for the appellant and learned Additional Public Prosecutor.

Learned counsel for the appellant submitted that though there is no evidence on record, the trial Court erroneously convicted the appellant. It is further submitted that there are good grounds to succeed in the appeal and the final hearing of the appeal may be taken considerable time. Therefore, he prayed the Court to allow this petition.

On the other hand, the learned Additional Public Prosecutor appearing for respondent, opposed the bail

petition, however informed the Court that there are no other cases pending against the appellant.

Perused the contents of the affidavit filed in support of the petition.

Considering the facts and circumstances of the case, this Court is of the view that the sentence of imprisonment can be suspended pending disposal of the criminal appeal, subject to conditions.

In the result, the sentence imposed on the petitioners/accused Nos.1 and 2 dated 30.01.2026 passed in S.C.N.D.P.S.No.12 of 2023 by the learned I Additional District & Sessions Judge at Karimnagar is hereby suspended pending disposal of the criminal appeal, subject to the petitioner executing a personal bond of Rs.20,000/- (Rupees Twenty Thousand Only) with two sureties of the like sum each, to the satisfaction of the learned I Additional District & Sessions Judge at Karimnagar.

During bail, the petitioner/appellant/ accused shall not indulge in any criminal acts, and in case of failure to do so, the respondent - State is at liberty to file petition for cancellation of bail.
