HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.3652 of 2019 ORDER:

The prayer of the petitioner in this case reads as under:- "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus directing respondent No.3 herein to pass orders on the application filed by the petitioner dated 25.01.2014 in file No.G/5415/2014 for issuance of O.R.C in respect of land in Sy.No.313 (Acs.10-28 gts) situated at Kondagadapa village, Mothkur Mandal now in Bhongir District and to pass such other order or orders as this Honourable Court may deem fit and proper in the facts and circumstances of the case."

The record reflects that the petitioner earlier filed Writ Petition No.40557 of 2014, wherein his prayer was as under: "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus declaring the inaction of Respondent No.3 in disposing of my application for issuance of Occupancy Right Certificate under the provision of the Inams Abolition Act 1955 in case No G/5415/2014 filed on 25012014 to an extent of Acs.10-28gts for the subject land in Sy.No.313 of Kondagadapa Village, Mothkur Mandal, Nalgonda District, as arbitrary, illegal and against the principles of natural justice and consequently direct the respondent No 3 to dispose of the same forthwith and to pass such other order or orders as this Honourable Court may deem fit and proper in the facts and circumstances of the case."

Writ Petition No.40557 of 2014 was disposed of by the erstwhile common High Court for the States of Telangana and Andhra Pradesh, vide order dated 21.01.2015, directing the Revenue Divisional Officer, Bhongir Division, Bhongir District, to pass appropriate orders on the application dated 25.01.2014 made by the petitioner for issuance of an Occupancy Rights Certificate within a

SK, J WP.No.3652 of 2019 Dt:22.02.2019 time frame. Having secured this order, the petitioner again seeks an order on the same lines.

This Court sees no reason to entertain the present Writ Petition when the petitioner was already granted the relief in Writ Petition No.40557 of 2014. The said order, even if not acted upon, would not cease to have effect and it is for the petitioner to take appropriate measures to secure implementation thereof. Leaving it open to the petitioner to do so in accordance with law, the Writ Petition is dismissed.

Pending Miscellaneous Petitions, if any, shall also stand dismissed. No order as to costs.
