The present writ petition is filed to declare the action of respondents 3 and 4 in calling the petitioner to the police station and threatening him to vacate and handover vacant possession of the leased premises, bearing No.3-6-83, situated beside SBH, Karimnagar Road, Jagtial Town, to respondents 5 to 7, pending a civil suit in O.S.No.340 of 2019 on the file of the learned Principal Junior Civil Judge, Jagtial, filed by the petitioner, as illegal, arbitrary and violative of principles of natural justice.

Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Home.

Learned Assistant Government Pleader for Home, on written instructions, dated 19.02.2020, a copy of which is placed on record of this Court, submits that, based on the complaint of the 5th respondent in the present writ petition, a case has been registered against the petitioner in Crime No.78 of 2020 for the offences under Sections 290 and 506 IPC and Section 155(2) Cr.P.C. on the file of Jagtial Town Police Station, on 07.01.2020. By the said written instructions, it is stated that except conducting investigation into the above said crime, the respondent police never interfered in the civil disputes of the petitioner, at any point of time. 4.

Having regard to the said submission made, since a case is registered against the petitioner and that the same is under investigation, the respondent police shall conduct investigation in accordance with the procedure laid down by law.

In view of the above, no further orders need be passed in this writ petition and the same is accordingly closed. Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs. _____________________ JUSTI CE T.VI NOD KUMAR Date:20.02.2020 GJ
