THE HON'BLE SRI JUSTICE M.GANGA RAO WRIT PETITION No.14438 OF 2007 ORDER:

This writ petition is filed to declare the notification issued under Section 4(1) of the Land Acquisition Act, 1894 (for short 'the Act') and the draft declaration under Section 6 of the Act, as illegal, arbitrary and contrary to the provisions of the Act and consequently to direct the respondents to drop the land acquisition proceedings in respect of the petitioners' houses bearing D.No.8-86/8 of Tiruchanur Village of Chittoor District.

This Court, while admitting the writ petition, granted interim direction in WPMP No.18136 of 2007, directing the respondents to maintain status quo with regard to the possession of house property bearing D.No.8-86/8 of Tiruchanur Village of Chittoor District.

The learned Assistant Government Pleader, on instructions, submits that as per the oral request of the petitioners to provide one shop near Tiruchanur temple to eke out their livelihood, a shop is provided and possession was also handed over to them.

Now, the learned counsel for the writ petitioners wants to withdraw the writ petition in the aforesaid backdrop.

Accordingly, the writ petition is dismissed as withdrawn. No costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
