The petitioner challenges the inaction of the respondent Andhra Pradesh State Road Transport Corporation in considering his candidature for appointment on compassionate grounds.
On 24-03-2015, Notice was issued and the learned Standing Counsel, who has since obtained instructions in the matter, would inform the Court that upon the death of the employee, in lieu of seeking appointment on compassionate grounds, additional monetary benefits have been claimed and a Division Bench of this Court, in an unreported Judgment in W.A.No.134 of 2015, dated 30-03-2015, held that since in the Scheme, the Corporation has made it very clear that the dependents of the deceased employee, who have availed the additional monetary benefit, shall not be eligible to stake a claim for employment under the 'Breadwinners Scheme', no such person can claim any such appointment under that Scheme. The Division Bench, therefore, granted liberty for challenging any such stipulation of the Corporation.
In that view of the matter and also in view of the statement made by the learned Standing Counsel that the petitioner has already availed the additional monetary benefit in lieu of appointment on compassionate grounds, this writ petition stands dismissed at the admission stage with liberty to challenge any such stipulation in the Scheme, but however, without costs. Consequently, the miscellaneous petitions, if any, stand disposed of. __________________________ NOOTY RAMAMOHANA RAO, J.
