ORDER

The petitioners, who are A1 and A2 in Cr.No.1148/2014-15 of Prohibition and Excise Police Station, Narsipatnam, Visakhapatnam District, registered for the offence punishable under Section 8(c) read with Section 20(b)(ii)(c) of NDPS Act, filed this petition under Sections 437 and 439 of the Code of Criminal Procedure, 1973, seeking bail.

2. Heard both sides and perused the material on record.

3. It is alleged that on 26.02.2015 at about 11.45 hrs., the Assistant Prohibition and Excise Superintendent, Enforcement Wing, Visakhapatnam, along with his staff conducted routine check and on suspicion, they stopped a lorry, wherein they found 700 Kgs of ganja in 35 white gunny bags and also cash of Rs.36,830/-.

4. Since the petitioners/A1 and A2 were in possession of 700 Kgs of dry ganja, which is commercial quantity, and they belong to Uttar Pradesh and Madhya Pradesh respectively, this Court is not inclined to grant bail to them.
