HON'BLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.1280 of 2020 ORDER :
The petitioner is one of the accused in Crime No.10(E)/97 on the file of the Central Bureau of Investigation, Hyderabad. He, along with the other accused therein, were granted anticipatory bail by the learned Special Judge for Economic Offences at Hyderabad in Crl.M.P.No.1873 of 2002, vide order dated 19.07.2002, subject to certain conditions. One of the conditions was that they should not leave the country without prior permission from the Court and should deposit their passports before the Superintendent, CBI, Hyderabad. The present petition under Section 482 Cr.P.C. is filed seeking relaxation of the aforestated conditions to enable the petitioner to travel abroad for a period of three months so as to perform UMRAH at Mecca, by directing release of his passport.
Perusal of the record reflects that the petitioner was granted such relief in the years 2015, 2016, 2017 and 2018.
Sri K.Surender, learned Special Public Prosecutor for the Central Bureau of Investigation, concedes this and states that he has no objection to the petition being allowed subject to imposition of the same conditions which were imposed earlier.
In that view of the matter, the criminal petition is allowed and the conditions in question imposed by the learned Special Judge for Economic Offences, Hyderabad, in the order dated 19.07.2002 passed in Crl.M.P.No.1873 of 2002 are relaxed for a period of two months permitting the petitioner to leave the country by taking back his passport, subject to his executing of a personal bond on a stamp paper of Rs.100/- and furnishing security for a sum of Rs.50,000/-, be it by way of cash or FDR or immovable property (by way of deposit of title deeds), along with an undertaking that he would return and resubmit his passport. In the event of non-compliance, the security or its value by realization shall stand forfeited.
