THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.1691 OF 2016 ORDER:

1 This petition is filed under Section 482 Cr.P.C to quash the proceedings against the petitioners/accused No.2 and 3 in C.C.No.1347 of 2015 on the file of the Court of the VIII Metropolitan Magistrate at Rajendranagar, Ranga Reddy District. 2 At the time of arguments, the learned counsel for the petitioners has sought permission of the Court to permit the petitioners to withdraw this Criminal Petition, with liberty to avail the remedies available to them under law, including filing of petition for discharge before the trial Court if the charges are not already framed. He further requested that the presence of the petitioners / A.2 and 3 before the trial Court may be dispensed with on each and every date of adjournment.

There is no dispute with the regard to the identity of the petitioners, who are accused Nos.2 and A.3 in the case. Even if the presence of the petitioners/A.2 and A.3 is dispensed with, no prejudice will be caused to the 2nd respondent. 4 In the result, the Criminal petition is dismissed, granting the liberty as prayed for. The presence of the petitioners who are accused Nos.2 and 3 in C.C.No.1347 of 2015 on the file of the Court of the VIII Metropolitan Magistrate, Rajendranagar, Ranga Reddy District is dispensed with on each and every dated of adjournment. However, the petitioners/Accused Nos.2 and 3 shall appear before the trial Court as and when their presence is so required. As a sequel, the miscellaneous petitions, pending if any in this Criminal Petition, shall stand closed.
