HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO Crl.P.M.P No.8497 of 2015 IN/ AND Crl.P. No.8473 of 2015 COMMON ORDER :

This Criminal Petition is filed by the petitioners/ accused Nos.1, 2, 4 to 6 under Section 482 Cr.P.C seeking to quash the proceedings of C.C. No.398 of 2013 on the file of XIII Additional Chief Metropolitan Magistrate, Nampally, Hyderabad, where learned Magistrate has taken cognizance for the offences under Sections 498-A and 325 IPC and Sections 4 & 6 of Dowry Prohibition Act, which is outcome of the report of 2nd respondent-de facto complainant in Crime No.929 of 2012 of Sanjeevareddy Nagar Police Station, Hyderabad, against petitioners/ accused Nos.1, 2, 4 to 6 and another by name Smt.Gurajala Sakkubai-accused No.3, who is not charged.

2) Pending disposal of the Criminal Petition, the 2nd respondent-de facto complainant, petitioners/ accused Nos.1, 2 4 to 6 are present and filed a joint memo in Crl.P.M.P.

No.8497 of with memorandum of understanding stating that the matter is amicably settled out of Court including taking consent divorce between de facto complainant and accused No.1 and the accused No.1 agreed to pay an amount of Rs.25 lakhs to be invested in the name of minor child i.e., Riddhima Gurujala, who is within the custody of mother, vide DD No.024463 dated

18.08.2015 drawn on ICICI Bank. It is stated by the de facto complainant that it is in the welfare of minor and herself she seeks permission to compound the offences.

3) Perused.

4) Having regard to the above, though the offences under Section 4 & 6 of D.P Act are not compoundable under Section 320 Cr.P.C, to sub-serve the ends of justice by invoking Section 482 Cr.P.C, permission is accorded. Accordingly, the Crl.P.M.P. No.8497 of 2015 is ordered and the offences supra, are compounded.

5) Consequently, the Criminal Petition is allowed and all the proceedings relating to C.C. No.398 of 2013 on the file of XIII Additional Chief Metropolitan Magistrate, Nampally, Hyderabad, is quashed. The bail bonds of the petitioner/ accused, if any, shall stand cancelled.

6) Miscellaneous petitions, if any pending in this Criminal Petition, shall stand closed.
