THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.1565 OF 2016 ORDER:

1. This revision is filed by the petitioner-accused aggrieved by the order dated 1.6.2016 passed in C.C.No.52 of 2016 by the Special Magistrate, Special Magistrate Court No.I, Kukatpally at Miyapur.

2. The petitioner is alleged to have committed the offence punishable under Section 138 of the Negotiable Instruments Act. On 4.3.2016, as the petitioner did not appear before the Court below, NBWs were issued against him. On issuance of such NBWs, the petitioner was produced before the Court below on 1.6.2016 and he was remanded to judicial custody and now, he has been in prison. Aggrieved by the same, the petitioner filed this revision.

3. Heard and perused the material available on record.

4. Learned Counsel for the petitioner submitted that the petitioner did not appear on the date of hearing in the above C.C as no summons were served on him and that his absence is not wilful.

5. Learned Additional Public Prosecutor opposed this revision.

6. Considering the facts and circumstances of the case and the submissions made by the learned Counsel for the petitioner, this Court is inclined to pass the following Order:

"The Court below is directed to release the petitioner on bail on condition of his executing a personal bond for a sum of Rs.5,000/- (Rupees Five Thousand only) with one surety for the like sum to the satisfaction of the Court below. The petitioner is directed to appear before the Court below as and when required."

7. Accordingly, the Criminal Revision Case is disposed of.

Consequently, the miscellaneous petitions pending, if any, shall stand closed.
