08.03.2022 LK, J I.A.No.1 of 2022 This petition is filed seeking to relax the modified condition No.(ii) vide order dated 01.07.2021 in I.A.No.1 of 2021 in Crl.P.No.1485 of 2021.
Learned counsel for the petitioner Mr. T. Bala Mohan Reddy, submits that earlier, this Court, by order dated 13.03.2021, while granting bail has directed the petitioner/A2 to appear before the Investigating Officer on every Saturday between 10.00 am to 2.00 pm., till completion of investigation or filing of the charge sheet. Thereafter, the petitioner has moved I.A.No.1 of 2021 seeking modification of the said condition, and this Court was pleased to modify the said condition and directed the petitioner to appear before the Investigating Officer on 2nd and 4th Saturday between 10.00 am and 5.00 pm., for a period of three months and thereafter, he shall appear before the Investigating Officer on every 3rd Saturday till completion of investigation and filing of charge sheet/final report. Learned counsel submits that the petitioner is a resident of Bihar and he has been complying with the said condition imposed by this Court from the last nearly one year and it is very

OFFICE NOTE difficult for him to travel on each date of appearance and hence, the said condition may be modified. Learned Assistant Public Prosecutor does not dispute the fact that the petitioner is complying with the said condition.
Taking into consideration the fact that the petitioner is appearing before the Investigating Officer from the last one year, this Court deems it appropriate to relax the said condition. However, whenever the presence of the petitioner is required for the purpose of investigation, the police concerned shall issue advance notice to the petitioner for his appearance, and on receipt of such notice, the petitioner shall appear before the police without fail.
Accordingly, I.A., is allowed.
