THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.20121 OF 2011 DATED: 05.06.2015 Between:

Maroof Ali .. Petitioner And The SHO, P.S. Musheerabad, Hyderabad, and others.

.. Respondents THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.20121 of 2011 ORDER:

By way of this writ petition, the petitioner sought a direction to the Station House Officer, Musheerabad Police Station, Hyderabad, to complete the investigation in Crime No.234 of 2010 and file a charge sheet. Basing on the written instructions dated 23.07.2011 received from the Station House Officer, Musheerabad Police Station, Hyderabad, the learned Assistant Government Pleader for Home informed the Court that the petitioner's private complaint filed before the learned XVII Additional Chief Metropolitan Magistrate, Hyderabad, was forwarded and registered as Crime No.234 of 2010 under Sections 406 and 420 I.P.C. by the Musheerabad police on 27.07.2010. Upon due investigation, the police found that the dispute between the complainant, the petitioner herein, and the alleged accused was purely civil in nature and did not warrant any prosecution on the criminal side. Notice was therefore given to the petitioner to that effect on 30.10.2010 and a final report under Section 173 Cr.P.C.

was also filed before the criminal court on 23.07.2011. In the light of the afore-stated developments, the grievance of the petitioner as to the alleged inaction on the part of the police authorities does not stand. It is for the petitioner to avail appropriate remedies in accordance with law in the light of the final report submitted by the police.

Reserving liberty to the petitioner to do so, the writ petition is dismissed. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
