THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITIION No.3037 of 2018 ORDER:

Heard learned counsel for the petitioners, learned Government Pleader for Home (Telangana) appearing for R1 to R4 and Smt.D.Madhavi, learned counsel for R5. When the matter is taken up, on written instructions, furnished by the Sub Inspector of Police, Adibatla Police Station, Rachakonda Commissionerate, it is submitted by the learned Government Pleader that, on the complaint of the first petitioner herein, police registered Cr.No.210/2018 under Sections 447, 427 r/w 34 IPC on 30.08.2017 wherein the fifth respondent was shown as accused No.1. It is further submitted that permission was obtained from the Assistant Commissioner of Police, Ibrahimpatnam Division on 30.12.2017 to refer the complaint of the petitioner as 'false' and that final report would be filed shortly before the Court concerned.

It is the further submission of the learned Government Pleader that, on the complaint given by the fifth respondent, police registered Cr.No.209/2017 under Sections 447, 427 r/w 34 IPC on 30.08.2017 and, after completion of investigation in the said crime, charge sheet was also filed before the learned IV Metropolitan Magistrate, Ibrahimpatnam on 30.12.2017 and the same was taken on file vide C.C.No.595/2017 and the first petitioner is facing trial in the said C.C.

above case, that too on the complaint of the petitioner, and proceeding with the investigation of the case, as contemplated under law, the respondent-police never interfered with life and liberty and peaceful possession and enjoyment of the lands of the first petitioner. Eventually, a request is made by the learned counsel for the petitioners to place the said written instructions on record and dispose of the Writ Petition.

Accordingly, the Writ Petition is disposed of, by placing on record the above written instructions. Miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
