THE HON'BLE SRI JUSTICE RAJA ELANGO Crl.R.C. No.2420 of 2014 ORDER :

The petitioners preferred the present Criminal Revision Case by invoking the provisions under Sections 397 and 401 of the Code of Criminal Procedure being aggrieved by the order dated 22-09-2014 passed in Crl.M.P.No.645 of 2012 in S.C.No.251 of 2011 by the VI Additional District & Sessions Judge, Markapur, Prakasam District, wherein and whereby the learned Sessions Judge dismissed the discharge petition filed by the petitioners herein invoking the provisions under Section 227 Cr.P.C.

2. Heard and perused.

3. After arguing for some time, the learned counsel for petitioners confined his argument and prayed to dispense with the presence of the petitioners before the trial Court.

4. Considering the facts and circumstances of the case, more particularly the fact that the entire village people are implicated in the present case, the presence of the petitioners is dispensed with before the concerned Court, except on the dates on which the trial Judge insists for their appearance. Apart from that, petitioners are directed to appear before the concerned court (i) to

answer the charge;

(ii) at the time of examination of eye-witnesses to the occurrence; and (iii) to answer examination under Section 313 Cr.P.C.

5. Accordingly, the Criminal Revision Case is disposed of.

6. Miscellaneous petitions filed in this revision, if any, shall stand closed.
