THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.1676 of 2025 ORDER:
This Criminal Petition is filed for grant of pre-arrest bail to the petitioners, who are arrayed as accused Nos.2 and 3 in Crime No.167 of 2025 of Uppal Police Station, Rachakonda Commissionerate.

The brief facts of the case are that on 02.02.2025, a complaint was filed by Smt. Malipeddi Rajitha, alleging harassment of her daughter, Boreddy Ravali, by her in-laws and husband, Rajashekar Reddy. Ravali, a school teacher, was married to Rajashekar on 23.05.2019, with a dowry of 10 tolas of gold and Rs.2 lakh. Initially, the couple lived harmoniously, but later, Rajashekar and his parents, Indiramma and Lingareddy, started demanding the one-acre land promised by Ravali's parents, leading to continuous harassment. After a quarrel, Rajashekar left Ravali and their children, and on 31.01.2025, he demanded that Ravali bring the property in exchange for his return. Mentally distressed, Ravali consumed poison and died on 01.02.2025. The complainant seeks legal
action against Rajashekar and his parents for dowry harassment.

Heard Sri K. Rajashekar, learned counsel appearing on behalf of the petitioners as well as Sri Syed Yasar Manoon, learned Additional Public Prosecutor appearing on behalf of the respondent-State.

Learned counsel for the petitioners submitted that the case of the prosecution against the petitioners are based on vague and general allegations, lacking specific evidence of their involvement in the alleged harassment or abetment of the deceased's suicide. He further submitted that the complaint primarily alleges that the deceased's husband made demands for property, but there is no direct link established between the actions of the petitioners and the death of the deceased. The petitioners, who are senior citizens with deep roots in society, were living separately from the deceased for 10 months prior to the incident and had no direct interaction with her. Therefore, he prayed the Court to grant pre-arrest bail to the petitioners by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the
petitioners stating that the allegations leveled against the petitioners are serious in nature. Therefore, at this stage, granting of pre-arrest bail to the petitioners does not arise. Hence, he prayed the Court to dismiss the criminal petition. 6.
After considering the submissions made by both the learned counsel and reviewing the material available on record, this Court finds that the petitioners are the parents of accused No.1, are senior citizens, and residing separately from their son. Notably, the complaint alleges that the deceased took her own life at her parents' residence, where she had lived for 10 months. In the light of these facts and circumstances, this Court deems it appropriate to grant pre-arrest bail to the petitioners subject to the following conditions: i.
The petitioners shall surrender before the Station House Officer, Uppal Police Station, Rachakonda Commissionerate, within two weeks from today, and on such surrender, the said Station House Officer shall release them on bail on executing a personal bond for Rs.15,000/- with two sureties, for the like sum each.
ii.
The petitioners shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023
and co-operate with the Investigating Officer in investigating the case.
iii.
The petitioners shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., till the filing of the charge sheet and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
