THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 28564 of 2017 ORDER:
Heard learned counsel for the petitioner and learned Government Pleader for Forests for respondent Nos.1 and 3. The petitioner states that she belongs to Koya Community, which is recognised as Scheduled Tribe. She is residing in House bearing No.5-1, KSM Colony, Chettakonda Village, which is a Tribal Village. She further states that the said house was constructed 50 years back. She also states that electricity connection was given and property tax is being paid. When the respondents are interfering with her possession, the present writ petition is filed. She filed certificate, dated 10.05.2016, issued by the Gram Panchayat and tax receipt, dated 10.05.2016, in support of her case.
Learned Government Pleader, on the basis of written instructions, submits that the husband of the petitioner encroached and established a group of temples over an extent of Acs.2.20 guntas and P.O.R.No.11/15-2015, dated 02.12.2015, is pending. Now, the petitioner raised a temporary house with asbestos sheets and cement bricks with a view to encroach the reserve forest and the allegation that the house was constructed 50 years back is denied. She further submits that in view of the
construction of the house already, respondent Nos. 1 and 3 would follow due process of law while evicting the petitioner. In view of the above submission, the writ petition is disposed of directing the respondents to follow due process of law if they want to evict the petitioner from the house claimed by her.
