O R D E R

This petition is field under Section 482 of Cr.P.C. to quash the proceedings in C.C.No.219 of 2016 on the file of V Additional Judicial Magistrate of First Class, Nellore, registered against the petitioners under Section 304-A of IPC.

The learned counsel appearing for the petitioners and the 2nd respondent, who is the de facto complainant, submitted that the parties have entered into compromise and by virtue of which, the petitioners have paid an amount of Rs.3,00,000/- to the 2nd respondent and that the 2nd respondent has no objection in allowing the criminal petition by quashing the C.C.No.219 of 2016. To that effect, the petitioners filed a petition in Crl.M.P.No.9656 of 2016 in Crl.P.No.8844 of 2016.

The petitioners as well as the 2nd respondent are present in person and they were identified by the respective counsel and the said parties filed a joint memo with terms of compromise in the Crl.M.P.No.9656/2016 in Crl.P.No.8844/2016. The said joint memo is signed by the parties and counter signed by their counsel. The joint memo is made part of this order. In view of the above, the Crl.M.P.No.9656 of 2016 in Crl.P.No.8844 of 2016 is allowed and consequently Crl.P.No.8844 of 2016 is also allowed in terms of the compromise and C.C.No.219 of 2016 on the file of V Additional Judicial Magistrate of First Class, Nellore, registered against the petitioners under Section 304-A of IPC is quashed.
