THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.11595 of 2015 ORDER:

This Criminal Petition is filed by the petitioner-accused No.1 under Sections 437 and 439 Cr.P.C. seeking to grant bail to him in Crime No.67 of 2015 on the file of Nandigam Police Station, Srikakulam District, registered for the offence punishable under Section 279 IPC and Sections 20(b) 8(c) and 25 of the NDPS Act. Heard and perused the material available on record. It is alleged that when an accident took place to the vehicle driven by the petitioner, the de facto complainant went there and found ganja outside the vehicle. It is alleged that huge quantity viz., 472 kgs of Ganja was seized from the vehicle. Learned Public Prosecutor submitted that the petitioner is a resident of Orissa and some material information is to be ascertained from him and if he is released on bail, it is very difficult to secure him.

Considering the facts and circumstances of the case and the submissions made by the learned Public Prosecutor and since the ganja seized from the vehicle is in huge quantity, this Court is not inclined to grant bail to the petitioner at this stage.
