THE HONOURABLE MR JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.2765 of 2015

ORDER

Heard learned counsel for the petitioner and learned Government Pleader for Home.

2. The petitioner's request for extension of parole has not been considered by the respondents. Hence, the present writ petition is filed.

3. Learned Government Pleader for Home, who has received instructions, states that the Government has considered the request of the petitioner for extension of parole for three months from 13.02.2015, but the said request was rejected in terms of Rules 17 and 19 of Sentence on Parole Rules, 1981. 4 .

In view of that, therefore, nothing survives in this writ petition. However, the petitioner requests that as his parole expires today, he may be granted time till tomorrow to surrender. Considering the said request, the petitioner is permitted to surrender before the second respondent on or before 14.02.2015 by 12.00 Noon.

5. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
