THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4314 of 2016 ORDER:

This Criminal Petition is filed under Section 482 of Code of Criminal Procedure (Cr.P.C.) to quash the proceedings in crime No.17 of 2016 on the file of the P.S., Kodumuru, Kurnool District, registered for the offences under Sections 498-A, 323 IPC read with Section 34 IPC and Sections 3 and 4 of the Dowry Prohibition Act.

Heard and perused the material.

Learned counsel for the petitioners submits that there is no specific allegation against the petitioners herein and further, the allegations are pertaining to the year 2010 and that the petitioners are married and are staying in the State of Karnataka and that they are not at all related to the family affairs of the de facto complainant.

This Court is of the view that the truth or otherwise of the above submission can be investigated into by the investigating agency, and as such, the police concerned are directed to drop the proceedings against the petitioners herein if it is found that the petitioners are married and are residing in the State of Karnataka and also found that they do not have any relation to the affairs of the de facto complainant. The police are directed to complete the investigation without arresting the petitioners and also directed not to harass the petitioners in the name of the investigation and also the petitioners need not be called to the police station. If the charge sheet is filed against the petitioners herein, the petitioners are given liberty to approach this Court seeking appropriate relief.

The Criminal Petition is accordingly disposed of. Miscellaneous Petitions pending in this Criminal Petition, if any, shall stand closed. _____________________ JUSTICE RAJA ELANGO 29.03.2016 pln
