THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.7675 of 2016 ORDER:
The criminal petition is filed under Section 482 Cr.P.C. to quash the proceedings in Cr.No.49 of 2016 of Shabad P.S, Ranga Reddy, registered for the offences punishable under sections 452, 324, 506 r/w.34 IPC. Heard the learned counsel appearing for the petitioners/A1 to A8 and the learned Additional Public Prosecutor, representing the State. The allegations made against the petitioners are that on 30.05.2016 the de facto complainant cut the road side tree in the process of work for sustenance, for which A1 questioned him, and again on the same day at 9.30 p.m all the petitioners went to the house of the de facto complainant armed with deadly weapons, beat him, abused him pointing out his community and threatened him with dire consequences. This is a matter which requires investigation by the police, and there are no valid grounds to quash the First Information Report.
In the facts and circumstances of the case and as requested by the learned counsel for the petitioner, the Criminal Petition is disposed of, directing the investigating agency to proceed with the investigation, however, without arresting the petitioners/A1 to A8 in the above crime, till the investigation is completed and the charge sheet is filed. Pending miscellaneous applications, if any, shall stand closed in consequence.
