HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION NO.1242 OF 2O2O ORDER:
This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973 (Cr.P.C.), is filed by the petitioner/ accused, for grant of anticipatory bail in Crime No.13 of 2O2O of W.P.S. City P.S., Warangal (U) District, registered for the offences punishable under Section 498-A of the lndian Penal Code and Section 4 of the Dowry Prohibition Act, 196 1 . Heard the learned counsel for the petitioner/accused, the learned Additional Public Prosecutor representing the respondent-State and perused the record.
In the FIR, it ts inter alia stated that the de facto complainant lodged a complaint stating that she got marriage with the accused on 21.05.1986 at Kazipet. They were blessed with female child on 13.1 1. 1987. The accused used to harass her by saying that she has no Government job, abused in filthy language and beat her. He harassed her and abused her and beat her by suspecting her character. When she took the help of her relatives, he harassed them through phone. She vexed her life with his behaviour and wanted to live separately. Learned counsel for the petitioner/ accused would submit that the petitioner/accused is innocent of the alleged offences and he has been falsely implicated in the above crime. It is submitted that the petitioner is aged about 65 years and his marriage was performed with the de facto complainant almost 33 years back. Because of misunderstandings between the mother of the petitioner and the de facto complainant, she gave ffi--i
# the present complaint. In the absence of the petitioner, the de /acto complainant beat the old-aged mother of the petitioner and left tJre matrimonial home and for that the petitioner lodged a report in Hayathnagar P.S. for taking necessary action prior to registration of this crime. Aggrieved by the same she filed the present complaint. It is further submitted that the petitioner/ accused is willing to furnish suitable security and abide by any condition which this Court deems Iit to impose. Hence, he prayed to grant anticipatory bail to the petitioner/ accused.
Learned Additional Public Prosecutor representing the respondent-State opposed to grant anticipatory bail to the petitioner/ accused.
Having regard to the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner/ accused on some conditions.
Accordingly, the Criminal Petition is allowed and the petitioner/ accused is directed to surrender before the Station House Officer, W.P.S. City P.S., Warangal (U) District, within a period of 15 days from the date of this order. On such surrender, the said Station House Officer shall release the petitioner/ accused on bail, on his executing personal bond for a sum of Rs. 10,000/- (Rupees ten thousand only) with two sureties for a like sum each to his satisfaction. On such release, the petitioner/accused shall abide by the conditions stipuiated under Section 438(21 Cr.P.C and co-operate with the investigating officer in investigating the case.
