HON'BLE SRI JUSTICE S.V. BHATT Writ Petition No.29642 of 2013 ORDER:

The petitioners complain against the inaction of the respondents 1 to 7 in not considering and taking action on the complaint dated 25.09.2013 filed against respondents 9 to 11 for misappropriation of Rs.4,00,00,000/ - of the funds of Central Gurudwara Saheb, Gowliguda, Hyderabad, etc., as illegal, arbitrary and unconstitutional.

2. Learned Assistant Government Pleader, by relying upon the written instructions dated 10.10.2013 submits that after receiving the complaint, G.D.

entry was made for conducting preliminary investigation. According to the investigation of the 6th respondent, the dispute stated in the complaint is a pure and simple civil dispute. Mr. Suresh Shiv Sagar, submits that the instructions of the 6th respondent are completely untenable, as the 6th respondent is unable to unfathomed the misappropriation pointed out by the petitioners. He seeks leave of the court to file a private complaint and to proceed in accordance with law. The statement of the learned counsel appearing for the parties is placed on record.

3. The writ petition is, accordingly disposed of, by granting liberty as prayed for. No order as to costs. Pending miscellaneous petitions if any in this writ petition shall stand dismissed in consequence. ____________ S.V.BHATT, J Date: 21.04.2017 BSS
