HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.18478 OF 2017 ORDER:

This writ petition is filed by the petitioners seeking to direct the respondents to follow due procedure before laying a road in the land of the petitioners.

It is the case of the petitioners that the petitioners are the absolute owners of plot No.64 in Sy.Nos.330/1,2,3 and 4 of Pidimgoyyi village. While so, on 19.5.2017 at about 11.30 a.m., the staff of the 2nd respondent came with JCB and started to lay down a 100 feet road highhandedly in their plot, without any prior information or without issuing any notice. Hence, the petitioners filed this writ petition. 3.

Heard and perused the material available on record. 4.

The main grievance of the petitioners is that the respondents are trying to lay down a road in their plots, without following the due process of law. Considering the circumstances of the case and the grievance of the petitioners, without expressing any opinion on merits, this Court is inclined to pass the following order:

"The respondents are directed to follow the due process of law if they intend to lay a road in the plots of the petitioners." 5.
