THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.18292 OF 2017 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, came to be filed seeking issuance of Writ of Mandamus declaring the action of respondents 1 to 3 in interfering with the civil disputes pending between the petitioners and unofficial respondents herein, without following due process of law, as illegal and arbitrary.

Heard the learned counsel for the petitioners and learned Assistant Government Pleader for Home appearing for respondents 1 to 6. With their consent, the Writ Petition is disposed of at the stage of admission itself. Though various grounds are raised in the writ petition, the learned counsel for the petitioners restricts his prayer submitting that without registering any crime, respondents 1 to 3 are trying to interfere with the civil disputes existing between the petitioners and respondent No.7 herein in respect of land admeasuring Acs.1-42 cents situated in survey No.46 of Agathavarapadu Village, Peddakakani Mandal, Guntur District.

Though no counter is filed, the learned Assistant Government Pleader, on telephonic instructions, submits that the allegations made in the Writ Petition are false and the respondentPolice never interfered in the civil disputes pending between the parties, as alleged by the petitioners.

Having regard to the rival submissions made, the Writ Petition is disposed of directing the respondents-Police not to interfere with the civil disputes pending between the petitioners and unofficial respondents, in respect of subject land, except in accordance with law Miscellaneous petitions pending in this writ petition, if any, shall stand closed.
