When the matter was listed on 08.06.2005, there was no appearance on behalf of the appellants, as such, the same was posted to 15.06.2005 under the caption 'for dismissal'. On 15.06.2005, the appeal was dismissed for default.

Subsequently, appeal was reopened on 21.08.2009 by setting aside the order dated 15.06.2005.

A perusal of the docket proceedings shows that though the matter is adjourned several times, there is no appearance on behalf of the appellants. Even the matter is listed today, there is no representation on behalf of the appellants. It shows that the appellants are not evincing any interest in prosecuting this Appeal.

In view of the same, this Appeal Suit is dismissed for nonprosecution. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in this Appeal Suit shall stands dismissed.
