The writ petition is filed by the petitioners alleging that the respondents are in the process of digging canal in the lands of the petitioners, which were not part of the acquisition in the earlier land acquisition proceedings.

Heard both sides and perused the material on record. 3.

On notice being issued, learned Government Pleader got placed on record the written instructions received from Assistant Executive Engineer - fourth respondent, SRSP Stage II, Sub Division No.4, Wardhannapet. In the said written instructions it is categorically asserted that "In Sy.Nos.203 a total extent of Ac.8.04 Gts, acquired up to 0.34 Gts and in Sy.No.204 out of Ac.4.29 Gts., acquired up to 0.07 Gts only an extent of Ac.1.01 Gts was acquired as stated supra for the excavation of internal canal. The Internal Canal excavation activity is going in the acquired land and Irrigation Department is not interfering with the possession and enjoyment of the petitioners over the other lands, except the land already acquired. No further land is required for excavation of canal except the land already acquired"

In the light of the specific stand of the respondents that the petitioners' lands are not being affected in any manner in construction of the canal, the writ petition is closed placing the

stand of the respondents on record. If the petitioners have any grievance in future, they are entitled to avail their legal remedies as per law. No order as to costs.
