HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.18980 OF 2017 ORDER:

This writ petition is filed by the petitioner seeking to declare the action of the 2nd respondent in issuing notice dated 23.5.2017 without considering his representation, as illegal and arbitrary. 2.

Heard and perused the material available on record. 3.

It is the case of the petitioner that he is the lessee of commercial shop No.64 situated at Koneti Kalwa Street, Proddatur, YSR Kadapa District and he started a retail oil shop in the said premises, and as there was loss in his business, he submitted representations to the 2nd respondent to reduce the rent. Without considering the same, the 2nd respondent issued the impugned notice demanding the petitioner to pay arrears of rent. Hence, the petitioner filed this writ petition.

Considering the facts and circumstances of the case and the grievance of the petitioner, without expressing any opinion on merits, this Court is inclined to pass the following order: "The 2nd respondent is directed to consider the representations of the petitioner and pass appropriate orders within 12 (twelve) weeks from the date of receipt of a copy of this order. Till then, the 2nd respondent is directed not to take any coercive steps against the petitioner."
