HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 1146 of 2009 ORDER:

Heard learned counsel for the petitioner, Government Pleader for Revenue and Government Pleader for Roads and Buildings.

The grievance of the petitioner is that the respondents are trying to demolish the house of the petitioner without any notice. When the matter is taken up for hearing the Government Pleader for Roads and Buildings submits that the road is laid without touching the property of the petitioner.

The Government Pleader for Revenue filed counter denying the allegations made in the affidavit and also stated that the road is being laid pursuant to an agreement arrived at between the authorities and the residents of the locality but however the said agreement is not filed along with the counter.

In view of the representation made by the learned Government Pleader for Roads and Buildings that the road is already laid without touching the property of the petitioner, no further orders are necessary in this writ petition. It is needless to mention that if the property of the petitioner is sought to be taken for any public purpose the authorities will follow the due process of law. Accordingly, the writ petition is closed. There shall be no order as to costs.

Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
