The grievance of the petitioner in this case was that the Circle Inspector of Police, Eluru Rural Police Station, Eluru, was not conducting proper investigation in Crime No.24 of 2011 on the file of Pedapadu Police Station, West Godavari District. Consequential direction was sought to the police authorities concerned to appoint another investigating officer in the place of the Circle Inspector of Police, Eluru Rural Police Station, and to conduct an unbiased investigation. Though no counter-affidavit has been filed by the respondents, Sri Krishna Dev, learned counsel representing Sri S. Niranjan Reddy, learned counsel appearing for respondents 7 and 8, produced a copy of the final report filed in Crime No.24 of 2011 under Section 173 Cr.P.C. before the learned II Additional

Judicial Magistrate of First Class, Eluru, West Godavari District. This detailed report, running into 36 pages, refers to the examination of various witnesses and records finally that upon the orders received from the Additional Director General of Police, CID, Andhra Pradesh, further action was dropped in the case. A notice was stated to have been served upon the complainant, the petitioner herein, informing him to that effect.

In the light of the afore-stated facts, it is clear that the prayer of the petitioner in this case has worked itself out and in the event he is aggrieved by the final report submitted under Section 173 Cr.P.C., it is for him to take appropriate steps in connection therewith in accordance with law.

Reserving liberty to the petitioner to do so, if not already done, the writ petition is closed.

Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
