THE HON'BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT APPEAL No. 45 of 2015 JUDGMENT: (Per the Hon'ble The Chief Justice Sri Kalyan Jyoti Sengupta) By the writ petition the writ petitioner-appellant challenged the notice of No Confidence Motion with regard to the functioning of the President of the Primary Agricultural Cooperative Society, Sathyanpally. The learned Trial judge at the admission stage passed interim order to the effect that No Confidence Motion may be proceeded with, however, result thereof should not be given effect to till the disposal of the writ petition. His Lordship dismissed the writ petition by order dated 02.12.2014 and, as such, the No Confidence Motion was carried and given effect to. The subsequent decision is not challenged before the Court. Therefore, we do not think that the challenge in this case any more survives.
Accordingly, the appeal is dismissed on that ground alone. However, we clarify that the judgment and order of the learned Trial Judge will not be a precedent in the future occasion to come. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
