THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No. 40014 of 2015 ORDER :

Heard learned counsel for petitioner and learned Government Pleader for Civil Supplies appearing for respondents.

2. Petitioner in this Writ Petition questions the proceedings dt.04.12.2015 of 3rd respondent suspending the petitioner's fair price shop dealership authorization. On the same day, a show cause notice was also issued to the petitioner by the 3rd respondent setting out a charge against him.

3. Although the counsel for the petitioner sought to contend that merely on the basis of allegations in Section 6A case registered against the petitioner, the suspension pending enquiry has been directed by the 3rd respondent, I am unable to agree with the said submission, because the impugned proceedings dt.04.12.2015 indicates independent application of mind. The petitioner is therefore directed to submit his explanation to the show cause notice dt.04.12.2015 issued by the 3rd respondent.

The 3rd respondent shall complete the enquiry into the allegations against the petitioner within three (3) months from the date of receipt of a copy of this order, after following the principles of nature justice and giving a personal hearing to the petitioner.

4. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Consequently, miscellaneous petitions if any pending in the writ petition shall stand dismissed.
